Hello Everyone, 

In this blog, we will discuss a Provision made in the year 1991, which is unheard to many of us. This provision is  "The Place of Worship(Special Provisions) Act, 1991".  I have written many articles on several issues like "Government Intervention on  Hindu Temples and how they are unconstitutional and goes against the fundamental essence of our constitution,  If you haven't read that blog, please click on the link below which will help you to understand how Hindu temples are under control selectively. Before proceeding I would like to tell you that this blog will be divided into two parts, First I will be explaining the act as it is, and secondly, I will explain the impact of the act on the majority population that we are unaware of.

Let's Get started, 

Every provision or law which is made has some or the other historical backgrounds to it, and the same goes with this provision also, This Provision was brought up in the year 1991. The act prohibits the conversion of any Religious place of worship of any community or denomination into another denomination. 

  • For Example,  a temple which was built in the year 1900, which later got demolished by an invader, and a mosque was formed on its surface, so If I wish to challenge the existence of the Mosque in the court,  this  Provision which was made in the year 1991, prohibits or restricts me to do so. 


This Special Provision of 1991, contains a declaration that a place of worship shall continue as it was on August 15, 1947,  In simple words,  The act was enacted to freeze the status of all places of worship in the country as on August 15, 1947. But an exception was made to keep the Babri Masjid and the  Ram Janm Bhoomi dispute out of its ambit. This act of 1991 is not applicable to any Historical and ancient Archaeological sites. 




This special provision was made by the then government of India lead by PV Narasimha Rao,  of congress (INC), as per them this act was brought up to reduce the tension and eliminate the chaos between the communities. But this is just one side of the picture, In this blog, I tried to explain you the provision as it is, but in the next blog, I will cover all the unfolded aspects of this "special provision of 1991" which are unconstitutional and are against the essence of the so-called secularism in India.
