UNDERSTANDING EXPRESSION OF FREEDOM AND HATE SPEECH

 Freedom of speech is not a license to abuse. It's a responsibility 

In recent years we all might have witnessed that freedom of expression has become a subject of debate. There are divided opinions of people around us. Some feel that there is very little freedom of speech left  in India and  and on the contrary some feel that free speech is a little too much in India and this opinion becomes very selective when it comes to a particular community. So, in this blog we will go and understand what is freedom of speech especially in terms of India. Further we will create a distinction between freedom of speech and hate speeches. Before starting this blog, I would like to inform that this blog will contain more facts and constitutional amendments and definitions regarding this topic and in the next blog we will discuss cases and recent examples to understand this issue and current scenarios in India. 

Let's get started,   

To really understand this topic we should understand, what does freedom of speech means in accordance with our constitution. Freedom of speech comes under Article 19.

  • It includes the right to express one's views and opinions at any issue through any medium ( by word of mouth, writing, printing, picture, films, movie etc. ). However freedom of speech and expression is not an absolute right.
  • Freedom of speech gives you the authority in an impartial manner to convey your thoughts and opinions but does not give you the license to mock or hurt any religion or community in specific.
  • One should understand the basic difference between freedom of expression and hate speech. Nobody should use freedom of expression as a shield to protect those spreading hate speeches by any means.
  • Hate speech is not defined specifically in our constitution but there are several provisions under IPC which provides the right to file a case against any individual or community for passing any remark due to which  the sentiments of any individual or a community are scraped.

 Recently there has been a clash between two sections of society, one claims that there is no freedom of expression left in India and India has become an intolerant nation and on the other hand there is a larger section of society which claims that they are being targeted directly and their sentiments are being hurt. This was an introductory blog on this topic and in the upcoming blogs I will provide you the truth backed with proper facts which will make a clear picture for you on the status of society.
